Terms and Conditions of Service

These terms and conditions (“Terms”) govern the provision of services by [Mercury Entertainment Group and any associated parties, hereafter referred to as “the Company,” to the customer, hereafter referred to as “the Client.” By engaging the services of the Company, the Client agrees to be bound by these Terms.

Booking and Deposits:

  • Booking Confirmation: A booking is considered confirmed when the Client has accepted a quote, provided all necessary details, and paid a 50% non-refundable deposit, which will be specified in the invoice provided. The deposit secures the date and services of the Company for the Client’s event.
  • Payment: Payment is due as outlined in the invoice provided by the Company. The balance is due no later than 14 days prior to the event date.
  • Refunds: Deposits are non-refundable. In case of event cancellation or postponement, any fees paid are not refundable. The Company may consider rescheduling the event if the Client provides an alternative that we are able to accommodate pening our availability.

Services:

  • Scope of Services: The Company agrees to provide DJ services as specified in the booking confirmation and details on the invoice. The Client agrees to provide the necessary information regarding the event, including the date, time, location, and any specific requirements, to enable the Company to provide these services effectively.
  • Replacement DJ: In the unlikely event that the assigned DJ becomes unavailable due to unforeseen circumstances, the Company will provide a DJ of equal value and expertise from our team. The Client will be notified of any changes as soon as possible.
  • Performance: The Company will make every reasonable effort to provide the agreed-upon services to the best of its ability. The Client understands that the success of the event may also depend on factors beyond the control of the Company, such as guest cooperation, venue facilities, and technical issues.
  • Access to Venue: The Client is responsible for ensuring that the venue provides appropriate access, electricity, and space for the DJ setup. Any costs associated with obtaining these services shall be the responsibility of the Client.

Cancellations and Postponements:

  • Client Cancellations: In the event of a Client-initiated cancellation the deposit is non-refundable.   The Company may consider rescheduling the event if the Client provides an alternative that we are able to accommodate pening our availability.
  • Company Cancellations: The Company reserves the right to cancel services if the Client is in breach of these Terms or for reasons beyond our control. In such cases, the deposit will be refunded, but the Company will not be liable for any further compensation or damages.

Liability and Damages:

  • Liability: The Company will not be liable for any loss or damage to equipment or injury to persons at the event caused by the Client or guests.
  • Equipment Damage: The Client will be held responsible for any damage to the Company’s equipment caused by the Client, guests, or any third party during the event.

Privacy and Data:

  • Data Use: The Company will collect and store the Client’s personal data for the purpose of providing services. This data will not be shared with third parties, except as required for event planning and execution.

Governing Law:

  • Jurisdiction: These Terms are governed by and construed in accordance with the laws of Victoria, Australia, and any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

By engaging the services of the Company, the Client acknowledges having read and understood these Terms and agrees to be bound by them. These Terms may be subject to change without notice, and it is the Client’s responsibility to regularly review them.
